These Terms and Conditions ("Terms") govern your access to and use of the websites, services, studios, programs, and community of TreyTech Studios, LLC, d/b/a TreyTech ("TreyTech," "we," "us," or "our"). By visiting our sites, booking a creative consult, engaging our services, applying to our network, or joining our community, you agree to these Terms.
TreyTech is a tech, media, and business consulting studio for the future economy. We operate through connected disciplines we call studios, currently Brand, Content, AI Transformation (TreyTech.ai), Digital, and Experience, supported by a vetted creative and consultant network. TreyTech, the studio names, and related marks are pending trademarks with the USPTO.
Every engagement begins with a creative consult. From there, the path is right-sized to the work:
You work with a single Engagement Manager as your point of contact. No production work begins before the applicable quote or agreement is approved.
We are creator-first. For paid client work, you receive the rights to the final deliverables you paid for, as defined in your agreement, typically upon full payment.
TreyTech, our network members, and our collaborators retain their own pre-existing tools, methods, know-how, templates, and portfolio rights, including the right to display non-confidential work as samples. TreyTech brand assets, the studio framework, and our marks remain our property. We do not claim ownership of a creator's underlying ideas or independent intellectual property.
For business and enterprise clients, any client intellectual property, proprietary materials, and confidential business information disclosed to TreyTech or its network remain the property of the client and are treated as confidential. They are used solely to perform the engagement and are governed by the confidentiality terms of your signed agreement, including any non-disclosure, master services, or statement of work agreement. The right to display work as a sample does not apply to materials marked or reasonably understood to be confidential.
Our Founding and Creative Network is made up of vetted independent professionals. Applying does not guarantee acceptance or work. Network members are independent contractors, not employees, and are engaged on a project basis at a fixed fee agreed before work begins. Members are responsible for their own taxes, equipment, and compliance. Confidentiality, IP assignment for specific client deliverables, and conduct expectations are set per project.
Our community, including any Discord server and live Open Studio sessions, is provided as is and may change or pause at any time. By participating you agree to be respectful, to not share others' confidential information, and to follow any posted community guidelines. Ideas and feedback shared in open settings are shared at your discretion. We are creator-first and will not knowingly misappropriate a member's intellectual property, but public conversations are not confidential unless covered by a signed agreement.
Business and enterprise client intellectual property and confidential information, and the personal and professional data of our creators and network members, are treated as confidential and are subject to the terms of the applicable signed agreement, including any mutual non-disclosure, master services, or statement of work agreement. We use such information only to deliver the engagement, limit access to the people who need it, and do not sell it.
Where a signed agreement is in place, that agreement controls how confidential information and data are handled, retained, and returned or destroyed. Absent a signed agreement, do not share information you consider confidential through public forms, channels, or community spaces, as we cannot guarantee confidentiality outside of a signed agreement.
We use and may recommend third-party tools and platforms, including scheduling, payment, design, and AI services. Your use of those services is subject to their own terms. We are not responsible for third-party platforms, outages, or changes. AI-assisted work is reviewed by real people; we are responsible for the quality of what we deliver.
Voluntary donations made to support TreyTech, including through our payment provider, are non-refundable and are not tax-deductible charitable contributions unless expressly stated. Donations support the growth of the studio and are not a purchase of services.
We deliver professional, high-quality work and stand behind it. That said, except as expressly stated in a signed agreement, our sites and services are provided as is without warranties of any kind, and we do not guarantee specific business, revenue, ranking, or performance outcomes.
To the maximum extent permitted by law, TreyTech and its network are not liable for indirect, incidental, or consequential damages. Our total liability for any engagement is limited to the amount you paid TreyTech for that specific engagement. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
Either party may end an engagement as set out in the applicable agreement. Fees for work performed and non-refundable amounts remain due. We may suspend or end access to our sites, community, or services for conduct that violates these Terms.
These Terms are governed by the laws of the State of Texas, without regard to conflict of laws rules. Disputes are handled in the state or federal courts located in the Dallas–Fort Worth area, unless your signed agreement says otherwise.
We may update these Terms from time to time. The "Last updated" date reflects the current version. Continued use of our sites or services after an update means you accept the revised Terms.
